Fair Use Policy (FUP)

• Vianet’s fair use policy (“Fair Use Policy) is designed to ensure that Vianet’s broadband service (Vianet Communications’ “Broadband”) is fast and reliable at all times for all customers. This Fair Use Policy forms part of and is incorporated into Terms and Conditions of Vianet Communications Pvt. Ltd.
• If any customer use file sharing software to upload and download any files containing very large amounts of data, this activity uses a lot of network resources and can affect the speed of the network and the Vianet Broadband service for other users. To ensure that the majority of our users donot suffer from a very small number of high bandwidth users, we  monitor the usage by looking at a number of factors including the amount of time excessive usage continues as well as the bandwidth used.
• Our system continuously monitors the data usage by each user. If the system determines your usage to be excessive and unfair, the speed of the link shall be throttled for the duration until your current package expires.
• The systems that are used to provide Vianet Broadband can identify very high bandwidth users and request that you manage your use of Vianet Broadband to ensure fairness to all users.
• Should we have to cancel Vianet Broadband for excessive usage, you will still be liable for any outstanding sums of your contracts. We may also make a charge for the amount of excessive usage.
