Vianet considers any and all messages transmitted via the Vianet services to be private communication between the User and the recipient. Vianet will not monitor, edit or disclose the content of a User's private as, except that User agrees Vianet may do so:
- As required by law;
- to comply with legal process;
- is necessary to enforce this license;
- to respond to claims that the communicator violated the rights of third-parties; or
- to protect the rights or property of Vianet or others.
User acknowledges, understands and agrees that Vianet may in its sole discretion report User to any local, state or federal authority or agency if User violates any of the Terms of Use and Privacy Statement of Service.
User acknowledges, understands and agrees that Vianet may in its sole discretion cooperate with any affected third party by providing information and/or data in either a civil or criminal forum if User violates any of the Terms of Use and Privacy Statements of Service.
User acknowledges, understands and agrees that Vianet does not endorse the content of any User as and Vianet is not responsible or liable for any unlawful, harassing, libelous, privacy invading, abusive, threatening, harmful, vulgar, obscene, tortuous, or otherwise objectionable content, or content that infringes or may infringe upon the intellectual property or other rights of another.
The client is fully responsible for all activities that occur under User's password or account. User agrees to immediately notify Vianet at This e-mail address is being protected from spambots. You need JavaScript enabled to view it of any unauthorized use of User's password or account or any other breach of security.
INDEMNITY
User hereby agrees to indemnify and hold Vianet Communications, and its subsidiaries, affiliates, officers, and employees, harmless from any claim or demands, including reasonable attorney's fee, made by any third party because of or arising out of User's use of the Vianet service, User's connection to the Vianet services, User's violation of this license, or User's violation of any right of another.
NO RESALE OF SERVICE
User agrees not to resell the Vianet services or use of or access to the Vianet service unless otherwise permitted by Vianet Communications. Any person or entity that resells any products and services owned by Vianet Communications with out the permission of Vianet Communications may be subject to civil and/or criminal penalty as prescribed by law.
TERMINATION
User agrees that Vianet Communications may terminate User's password, account or use of the Vianet services if Vianet Communications believes that User has violated or acted inconsistently with the letter or spirit of this license or that User has violated the rights of Vianet Communications or other users or parties.
LIMITATION OF LIABILITY
User agrees that Vianet Communications shall not be liable for any direct, indirect, incidental, special or consequential damages, resulting from the use or the inability to use the Vianet services or the Vianet products or for cost of procurement of substitute goods and services or resulting from any goods or services purchased or obtained or messages received or transactions entered into through or from the Vianet services or resulting from unauthorized access to or alteration of User's transmissions or data, including but not limited to, damages for loss of profits, use, data or other intangible, even if Vianet Communications has been advised of the possibility of such damages. User further agrees that Vianet Communications shall not be liable for any damages arising from interruption, suspension or termination of Vianet services, including but not limited to direct, indirect, incidental, special, consequential or exemplary damages, whether such interruption, suspension or termination was justified or not, negligent or intentional, inadvertent or advertent. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so some of the above limitations may not apply to you.
Vianet Communications expressly disclaims any and/or all liability for inbound mobile phone roaming charges, mobile data charges and/or other like or unlike third party charges related to the use of Vianet Mobile, Vianet Web Calling, Vianet SMS Calling, Vianet Callback and/or any other Vianet service from a mobile phone while it is roaming.
CHANGES IN THIS LICENSE
Vianet Communications expressly reserves the right to change the terms of the license without notification.
The section titles in this license are for convenience only and have no legal or contractual effect.
